Real estate and planning

Our real estate and planning department is composed of a highly specialised professional team that provides comprehensive legal advice concerning real estate matters to clients in Spain and abroad, and to private and public institutions, throughout all the phases involved in the real estate field, encompassing risk assessment, and in close collaboration with the tax and financial law departments, thanks to a multidisciplinary team.

The extensive experience of the professional team involved in this work has led to advice being provided for large real estate developments to implement all kinds of real estate assets (parks and shopping centres, offices, distribution and industrial warehouses, hotels, residential properties, etc.), from urban planning and land management to the acquisition, development, construction, sale, lease and financing of these real estate assets.

It provides advice on real estate contracting, drawing up and preparing agreements for all kinds of sale & leasebacks, earnest money, purchases, leases, swaps, purchase options, building and operating agreements, project management, ground rights, assignment of land by elevation, creating encumbrances and other rights in rem, land groupings and separations and legal incorporation and registration of real estate complexes.

It is also specialised in processing urban planning and management instruments, providing comprehensive legal advice to collaborating urban institutions, taking part in sale and acquisition processes of public assets related to urban developments and uses, in procedures for protection of urban planning legality, expropriation and estate liability procedures, administrative appeals and acting as legal counsel in contentious administrative appeals concerning penalties, expropriations, authorisations, licences, protection of urban planning legality, orders for closure and actions against urban planning and management instruments.

It conducts due diligence processes for real estate assets and investment and disinvestment processes, recovery, regularisation and optimisation of real estate assets and financing for acquiring real estate assets and infrastructures.
